UNPACKING RESPECT@WORK

In early 2020, the Australian Human Rights Commission’s (AHRC) landmark Respect@Work Report was released.

It found that one in three Australians has experienced sexual harassment at work, and made a number of recommendations for change.

Those recommendations will soon put the onus on employer organisations to take steps that will prevent sex-based harassment and discrimination in their workplaces.

But what will these new laws really mean for employers?

Community and political consensus is clear that Australia needs to change the way it thinks about what constitutes a ‘safe workplace’.

The Anti-Discrimination and Human Rights Legislation Amendment (Respect at Work) Bill 2022 recognises this. It enacts legislative recommendations which shift the focus from reactive, complaints-based responses regarding individual incidents to a more proactive and preventative approach.

It puts the onus on employers to assume harassment and discrimination is happening, and take action to prevent and eliminate it.

What exactly employers should do to meet their ‘positive duty’ is yet to be seen, but legal experts have shed light on how these provisions will likely be interpreted. 

To help employers prepare, Future Women’s Head of Research and Insights Ruby Leahy Gatfield and Director of Diversity and Inclusion Programs Tarang Chawla facilitated a discussion with a distinguished panel of experts, including Padma Raman, Prabha Nandagopal, Dr Katie Spearrit and Dr Karen O'Connell, to unpack the new legislation and what it means for employers.

WHY EMPLOYERS SHOULDN’T BE SCARED OF RESPECT@WORK

We break down what the legislation means for employers in practical terms and what they can do to meet their new responsibilities head on.

GET AHEAD OF THE CURVE

The Respect@Work Bill prohibits hostile environments on the basis of sex and requires employers actively prevent sexual harassment in the workplace. 

For the first time, employers will be liable for the behaviour of their employees, unless they can show they took proactive steps to prevent an alleged incident. 

This ‘positive duty’ to take practical action can include embedding training for managers on gender inequity and the causes of sexual harassment (like Change Makers), or putting in place support staff and processes on how to respond.

TAKE ACTION

For too long, men have been left out of the gender equality conversation. People of all genders need to be engaged and active on equality if we’re going to stamp out sexual harassment and gendered discrimination for good. 

Change Makers is Future Women’s two-day training program for mid-to-senior career men, providing the tools, language and confidence they need to build inclusive, gender-equal workplaces. It’s the only program of its kind in Australia, developed in consultation with Sex Discrimination Commissioner Kate Jenkins.

The success of this program is significant, and has been proven effective in a range of settings, industries and employee levels.

In the past year, Future Women has delivered over ten sessions of Change Makers to more than 240 participants, including a number of bespoke programs for specific organisations. Of these participants:

  • 99% said they could apply learnings in their workplace
  • 98% said the facilitators were engaging 
  • 95% said the topics covered were relevant
  • 95% said the Change Makers experience was valuable.
  • 100% said the program met their expectations, with 79% saying their expectations were exceeded.
